VIDEO: Using Strategic Litigation to Enforce the Right to Information in Latin America: a Case from Argentina
Strategic litigation, or the use of the courts to achieve structural reforms in institutions and legislation, is a common practice used by civil society organisations (CSOs) in Latin America. In this video, Alvaro Herrero, Executive Director of the Association for Civil Rights (ADC), describes the process undertaken by ADC to compel the National Institute of Statistics and Censuses to disclose the methodology used to calculate the Consumer Price Index. Focusing on the context of Argentina, he explains the reasons why it is sometimes necessary to resort to strategic litigation and the challenges faced by CSOs in using the strategy to enforce the right to information.
